Office Spaces in Dubai

Rent Agreement & Office Space Services

The steps required to rent a space for a company in Dubai are similar to those required to rent a Dubai property.
Welcome to UAE Free Zones
A free zone is a geographical region allowed to perform a predefined business activity or set of business activities in the UAE. Businesses that wish to operate in the Dubai Free zone require a license. The free zone licenses are issued based on the type of business activity/activities an organization conducts.

Free Zone Authority (FA) is the governing body that regulates and is in charge of the pivotal activities connected with free zone operations and license issuance. Therefore, the commercial laws that govern the mainland companies in the UAE do not apply to the businesses that operate in the free zone.

When your business gets approved to perform in the Free Zone, the Free Zone authority will issue any of the Dubai Free zone licenses such as Trade License, Industrial License, Service License, or National Industrial License.

For a business, the location of its office is crucial to its success. In Dubai, there is a wide selection of commercial spaces available for rent or lease. They may have different requirements, rules, or policies that a prospective tenant will need to follow. All of which could be found in the rental agreement. This critical document will also indicate the office space services offered by the Landlord. A business must examine the agreement meticulously because once it is signed, its contents are legally binding. If there is an unfair clause, it can be difficult to remove and result in an expensive and time-consuming lawsuit.

Generally, the rental agreement is filled with legal jargon; therefore, ordinary individuals will find it difficult to understand its contents. While large companies have in-house lawyers who would scrutinize the document before signing it, start-ups and small businesses cannot afford the same luxury. Therefore, to ensure they are not subjected to legal disputes, our team will check the documents and make sure they are beneficial for the tenants.

Some of the common issues we protect our clients against are as follows:

Bearing all or most of the maintenance expenses

Some landlords may not adequately define their responsibilities regarding maintenance and repair in the rental agreement. Therefore, the charges may eventually be borne by the tenant.

    Undue rent increases

If there is a stipulation in the agreement that allows undue rent increases. In that case, the tenant may be subjected to sudden spikes in the rent. This can also occur due to intentional vagueness in the Common Area Maintenance policy, which some landlords use to cover roofing repairs and hire new security guards.

Harsh restrictions to the assignment provision

If a tenant wishes to sell their business while there is time left on the lease, typically, they need to seek approval from the Landlord for the new tenant. While this is not innately a problematic clause, sometimes severe restrictions can be included in the agreement. For example, they may state that the assignment clause only applies to original tenants, they can nullify the lease if the business plans to transfer their operations to another company or charge a hefty premium if the assignment is being considered.

Our team of experienced lawyers will peruse the rental agreement to ensure that the tenant is not in a vulnerable position. If any concerns arise, the tenant could then negotiate with the Landlord and request a new lease which will be more beneficial. Their lawyer will be beside them through the entire process, so a company can be assured they are receiving an excellent agreement.
